The U.S. Supreme Court is weighing whether to allow a 5th U.S. Circuit Court of Appeals order that would block nationwide mail delivery and telehealth prescribing of mifepristone, the drug used in the first step of most medication abortions.
The Fifth Circuitâs ruling in Louisiana v.
FDA, issued May 1, reinstated an inâperson dispensing requirement that the FDA removed in 2023; the high court placed a temporary administrative stay while it considers emergency filings from manufacturers Danco Labs and GenBioPro.
The stay is due to expire May 11 unless the justices act.
Providers and pharmacies, particularly in California, say they are prepared to shift quickly to alternative protocols â chiefly misoprostol-only regimens â which WHO and clinicians say are somewhat less effective and can be more painful.
About two-thirds of U.S. abortions used medication in recent years, and a growing share are prescribed via telehealth and delivered by mail.
Legal uncertainty and a largely silent federal government have left suppliers, clinicians and patients bracing for rapid changes in access and distribution across state lines.
