A Los Angeles Superior Court judge ruled April 17–18, 2026 that a civil negligence suit by gaffer Serge Svetnoy over the 2021 “Rust” on-set shooting will proceed to trial on Oct. 12, 2026.
Judge Maurice Leiter denied summary judgment motions from Rust Movie Productions, Alec Baldwin and Baldwin’s company, allowing claims of negligence, intentional infliction of emotional distress and punitive damages to move forward; a separate assault count against Baldwin was dismissed.
The suit alleges cost-cutting and safety lapses on the Bonanza Creek Ranch set where a prop revolver discharged on Oct. 21, 2021, killing cinematographer Halyna Hutchins and wounding director Joel Souza.
Svetnoy, who was near Hutchins when the shot fired, says he narrowly escaped injury and has suffered trauma since.
Baldwin was earlier cleared of criminal charges after a New Mexico judge dismissed an involuntary manslaughter case in 2024 amid findings of withheld evidence.
The armorer, Hannah Gutierrez-Reed, was convicted of involuntary manslaughter in 2024 and served time.
Lawyers for the parties did not immediately comment on the judge’s ruling.
